In a significant turn of events, the Passenger Rail Agency of South Africa (PRASA) board has confirmed the reinstatement of Zolani Kgosietsile Matthews as the Group Chief Executive Officer (GCEO). This decision complies with the recent Labour Court judgment made on 1 July 2024.
Matthews’s initial dismissal from the GCEO position by the PRASA board in December 2021 followed an intensive inquiry led by a seasoned senior counsel. The investigation revolved around accusations that Matthews did not disclose material information regarding his dual citizenship—an oversight deemed significant by PRASA.
However, media sources disclosed that retired judge Robert Nugent later countered the board’s decision by ruling in favor of Matthews's reinstatement, including compensation for back pay, during arbitration proceedings. This ruling prompted PRASA to seek a review from the Labour Court.
Finally, the Labour Court upheld Judge Nugent's decision, affirming the validity of Matthews's employment contract, thus mandating his return to the helm of the PRASA.
In light of this development, PRASA has publicly announced its commitment to respect and implement the court's order. A PRASA spokesperson emphasized the board's dedication to its responsibilities and informed that the agency will enter into discussions with Matthews to understand the full implications of the judgment and chart a way forward.
"The PRASA Board of Control remains committed to discharging its duties with the utmost diligence," added the spokesperson in their statement on Wednesday. As the transport agency braces for Matthews’s return, it seeks patience from the public and stakeholders during this transitional phase.
