In a landmark ruling on February 14, 2025, the Mthatha Specialised Commercial Crimes Court sentenced 42-year-old Hlobisile Mdlalose to ten years of direct imprisonment for her involvement in sophisticated cyber fraud and money laundering activities. This sentencing marks a significant triumph for the Mthatha-based Serious Commercial Crime Investigation team of the Hawks, who have tirelessly worked to bring Mdlalose to justice.
The case dates back to July 7, 2022, when an unsuspecting victim was enticed by an online advertisement posted by Mdlalose for a house sale in Newtown, Lusikisiki. Believing Mdlalose to be a legitimate estate agent, the victim engaged in communications to secure the property. The process included exchanging official documents and transferring R650,000 into a bank account provided in an email from what appeared to be Fotoh Associates Inc. Attorneys, associated with the property transaction.
It later emerged that the account was fraudulent and not linked to the aforementioned law firm. This revelation came only after the victim was informed by the supposed attorney’s office that they had not received any funds. The victim's financial loss and the subsequent investigation by the Hawks led to Mdlalose's arrest in Johannesburg on September 13, 2023. Despite posting R8000 bail and making several court appearances, justice prevailed with her conviction and subsequent sentencing.
The Director of Public Prosecutions (DPP) in Mthatha, commended the dedicated efforts of the Bizana and Mthatha teams of the Serious Commercial Crime Investigation (SCCI) division. Major General Obed Ngwenya, the DPCI Provincial Head, heralded the sentencing as a milestone in the fight against cybercrime and lauded his team for ensuring a harsh penalty for the accused.
This case highlights the critical and ever-present threat of cyber fraud, emphasizing the importance of vigilance in online financial transactions, particularly in real estate dealings. It also underscores the adeptness and perseverance of South Africa's judicial and investigative bodies in curbing cybercrime's scourge.
