In a significant move against corruption within South African local governments, the Special Investigating Unit (SIU) conducted a targeted operation at the Masilonyana Local Municipality in the Free State Province. On the morning of 9 December 2024, SIU officials, together with officers from the Hawks and the South African Police Service, executed a warrant issued under Proclamation 182 of 2024, aiming to uncover any misconduct related to the refurbishment of the Brandfort Water Treatment Works and the upgrading of the Brandfort Sport Centre. These investigations address potential undue benefits to municipal officials and other involved parties, which could lead to unauthorized, irregular, or fruitless and wasteful expenditure.
The raid was not the first step but rather the culmination of efforts to engage with the Municipality since the proclamation's publication on 13 September 2024. The SIU had attempted multiple times to access necessary documents through formal requests, which were persistently ignored by municipal officials, ultimately leading to this decisive legal intervention.
The documents and devices seized during the search are critical for the auditing and compliance concerning tenders awarded between 1 January 2013 and 13 September 2024. The comprehensive list of seized items included various forms of electronic equipment and hard copy documents, which are expected to provide essential data for further investigations.
Empowered by the Special Investigating Units and Special Tribunals Act of 1996, the SIU is authorized not only to carry out such operations but also to subpoena additional records, such as bank statements and cellphone records, and to interrogate witnesses under oath. The SIU’s mandate allows it to initiate civil actions to address any discovered acts of corruption, fraud, or maladministration. Any evidence of criminal activity uncovered during their investigations will be forwarded to the National Prosecuting Authority for potential prosecution.
