NPA Gauteng Seizes over R170 Million in Forfeiture Assets to Combat Organized Crime

In an assertive crackdown on organized crime and corruption, the National Prosecuting Authority (NPA) of Gauteng has successfully seized forfeiture assets worth approximately R173 million during the 2023-24 fiscal year. This substantial achievement underscores the relentless efforts in tackling high-profile economic crimes affecting South Africa’s socio-economic landscape.





The NPA's director of public prosecutions in Gauteng, Sibongile Mzinyathi, reported an impressive conviction rate of 88.9% in organized crime cases and 90.5% in complex commercial cases. Specific to complex tax-related offenses, the prosecution success rate stands at 90.9%.


A significant portion of the seized assets was derived from operations against illegal mining syndicates and fraudulent activities involving Eskom, the state-owned electricity utility. In one notable instance, the Asset Forfeiture Unit (AFU) executed three forfeiture orders in March, targeting illegal mining kingpins, accumulating assets worth R18 million sourced from the unauthorized trade of unwrought gold in the Khutsong area near Carletonville.


Further elevating the NPA's successful interventions, Mzinyathi highlighted forfeiture orders valued at R33 million in relation to maladministration and corruption at Eskom’s Kusile power station. Moreover, other properties and cash worth R29 million were frozen as part of efforts to dismantle a syndicate accused of siphoning funds from Eskom.


Adding to the series of fiscal recoveries, Mzinyathi shared insights into an inquiry concerning theft from the National Lotteries Commission. This sophisticated financial probe led the AFU to initiate 18 applications for forfeiture amounting to roughly R93 million, with assets including high-value properties and vehicles.


Despite these achievements, the NPA in Gauteng continues to grapple with challenges, chiefly attributed to the scarcity of specialized personnel capable of handling these intricate cases effectively. Mzinyathi expressed concerns over the protracted nature and aggressive defense seen in most corruption trials, which tend to delay the finalization of these matters.


Referring to the highly publicized Senzo Meyiwa murder trial, ongoing since the South African soccer star's death in 2014, Mzinyathi indicated that the state’s presentation of evidence is nearing completion, marking a critical phase of the trial.


Overall, the NPA's rigorous pursuit of justice in Gauteng led to a conviction rate of 81.7% in murder cases and an exemplary 100% success rate in prosecuting femicide during this fiscal year, highlighting its unwavering commitment to upholding law and order and securing justice for victims of serious crimes.
