The Battle Over Nkandla: EFF's Legal Threats Against Zuma Meet Resistance

In the ongoing political drama, MK Party (MKP) MP Mzwanele Manyi stands firm in his belief that former President Jacob Zuma's residence, Nkandla, will withstand the legal challenges threatened by Economic Freedom Fighters (EFF) leader Julius Malema over “unpaid legal fees”.





Earlier in the week, Julius Malema voiced intentions to initiate a legal battle aiming to recover the money purportedly owed by Zuma, specifically targeting his assets which include his Nkandla home. "We have a court order, and we want our money," Malema articulated, underlining a robust approach towards the collection of these funds.


However, during MKP's anniversary held at Vosloorus Stadium, Ekurhuleni, Manyi expressed not only his confidence in the inadmissibility of attaching Nkandla to settle any dues but also invoked a tone of reconciliation and understanding towards the EFF. He highlighted that Nkandla is situated on Ingonyama Trust land. This categorization as Trust land renders it unattachable since it does not constitute private property, thus providing a legal shield against asset seizure claims.


Despite the legal and political fervor, Manyi sent out an olive branch to the EFF, stating, “We love the EFF, we have no war with them.” He acknowledged the hardships faced by members moving from EFF to MKP and emphasized understanding their pain and disappointment. This empathetic stance reflects an intent to ameliorate tensions rather than inflame them.


Malema’s aggression is not isolated to verbal exchanges with the MKP but extends into Zuma’s financial dealings as well. Earlier this year, Zuma faced financial ramifications when VBS Mutual Bank’s liquidator Anoosh Rooplal directed the partial freezing of his account held with FNB, related to defaults on his home loan payments for Nkandla. This financial scrutiny from various fronts highlights the embattled situation of the former president.


The friction between EFF and MKP, as cited by Manyi, burgeons from recent recruitments by MKP from EFF’s leadership, which Malema sharply criticized, labeling MKP as "an enemy of the EFF." These developments mark a further escalation in the political rivalry that has simmered between these parties.


As the situation unfolds, it’s clear the stakes are high, with significant legal and political implications. The outcome of this legal confrontation could set precedents for property rights under traditional and trust-held lands, influencing future legal formations and political alignments within South Africa’s vibrant political landscape.
