Eastern Cape Man Penalized for SARS Fraud

In a stern warning against financial misconduct, the East London Regional Court has meted out justice by convicting and sentencing Gary David Murray, a 56-year-old resident of the Eastern Cape, for defrauding the South African Revenue Service (SARS). The court's ruling, which arrived on the heels of a meticulous investigation by the Hawks, reflects the South African judiciary's unyielding stance on tax fraud.


Gary Murray's entanglement with the law began when he was arrested by the East London Serious Commercial Crime Investigation unit of the Hawks on August 19, 2020. His arrest followed the discovery of fraudulent activities he engaged in nearly thirteen years prior. On December 28, 2007, Murray falsely submitted invoices and tax returns to SARS, deceitfully manipulating the system to generate a unwarranted tax refund.


SARS, during a routine auditing, flagged irregularities in the payments made to Murray and promptly referred the case to the Hawks for an extensive investigation. As the facts unraveled, it became glaringly evident that SARS had suffered a financial loss over R600,000 due to Murray's duplicitous conduct.


Throughout numerous court appearances leading up to his conviction, Murray faced the gravity of his actions. The East London Regional Court, presided over on September 3, 2024, issued a penalty that serves both as punishment and a cautionary tale to would-be offenders. Murray was ordered to pay a fine of R250,000, with a prompt payment of R20,000, followed by a 24-month period in which he will fulfill the remaining amount through monthly installments of R10,000. Should he default, he faces a five-year prison sentence, suspended for five years.


The Hawks' successful crackdown on this case underscores the unit's efficacy and dedication to combating white-collar crimes in South Africa. The Provincial Head of the Hawks, Major General Mboiki Obed Ngwenya, took the occasion to acknowledge the team's diligence and heralded the positive outcome of the court proceedings.
