Former Head of Gauteng's SIU Incarcerated for Misappropriating Trust Funds

In a stunning fall from grace, Sifiso Kunene, the former head of the Special Investigating Unit (SIU) for Gauteng province, has been sentenced to four years in prison for theft of trust funds, marking a severe breach of legal and ethical standards. This significant decision comes with a cautionary suspension: two years of the six-year sentence will not be served, provided Kunene avoids further theft convictions over the next five years.

This case revolves around a payout from the Road Accident Fund (RAF). The fund had paid approximately R 226,000 for a claim into a trust account administrated by Kunene back when he served as an attorney in the legal partnership of Kunene Masango Incorporated. The client involved had consented to remunerate Kunene with a 25% contingency fee from the RAF payment. However, Kunene illicitly appropriated R 170,000, which was rightfully owed to the claimant notwithstanding his legal fee.

Natasha Kara, the Regional National Prosecuting Authority (NPA) spokesperson, recounted the circumstances leading to Kunene's conviction. In 2009, his ex-partner had initiated a claim with RAF after the tragic passing of the claimant's fiancé in a car accident. However, following this partner's own legal troubles and subsequent imprisonment, the client's case went directly through Kunene.

Despite assurances from Kunene that the claim was under process, a direct inquiry to the RAF by the claimant in March 2015 provided the grim revelation that the due amount had been dispensed in August 2014. Upon being confronted, Kunene admitted to misappropriating the funds due to financial problems, leading the complainant to report him.

During the legal proceedings characterized by denials and blame-shifting on Kunene's part, concrete evidence was presented by the state, including bank records showing the disputed money transfers, along with testimonies pointing to his sole control over the firm's bank accounts from July 2012. The victim expressed deep trust betrayal, emphasizing the impact of the theft on her child's welfare given the death of her fiancé.

The case serves as a stark reminder of the accountability required in positions of authority and trust, particularly within the legal community. The NPA's approval of the sentencing reinforces the gravity of the misconduct and the imperative of upholding integrity and justice, even against the backdrop of financial distress.
