In a pursuit of justice that has seen numerous twists and turns, the National Prosecuting Authority Investigating Directorate (NPA ID) remains determined to see the Estina dairy farm case return to court promptly. This resolution comes after the Free State High Court's decision to strike off the high-profile case from its calendar—a setback that the NPA attributes to a technicality raised by the defence rather than a reflection of the case's merit.


The complexities of the case intensified when the defence invoked Section 342 A of the Criminal Procedure Act, claiming an incapacity to access the electronic version of the voluminous Gupta leaked emails, which form a crucial part of the prosecution's evidence. Despite this hiccup, NPA spokesperson Advocate Mthunzi Mhaga highlighted that the State had furnished the defence with both hard copies and electronic versions of the contentious emails, the latter being delivered as recently as 15 June 2024.


The NPA's commitment to resolving any issues regarding the evidence was evidenced by their provision of a technical expert to assist the defence, thus demonstrating their keenness to move forward without delay. Advocate Mhaga accentuated that the prosecution was fully prepared to proceed with the trial initially earmarked for 5 August 2024, with witnesses at the ready and seasoned Senior Counsel overseeing the integrity of the case brought against the implicated individuals in the Estina scandal.
