In a significant ruling that underscores the severity of gender-based violence in South Africa, the North West High Court in Klerksdorp handed down a life sentence to 52-year-old John Marumoagae on Thursday, 01 August 2024, for the murder of his former partner Duduetsang Mokgethi.

The incident, which has reverberated across the community, unfolded when Marumoagae, a security officer, departed from his job on the evening of Saturday, 18 February 2023. He proceeded to confront Mokgethi at a local tavern in Tigane Township, near Hartbeesfontein. A public dispute ensued over allegations of infidelity. The altercation continued outside the tavern, which was the last time Mokgethi was seen alive before her body was found the following day in an open field by a shocked passer-by.

This heinous act triggered a police investigation which encountered initial challenges due to lack of evidence; however, the pivotal turning point came when the Anti-Gang Unit assumed control of the case. Their meticulous investigative work uncovered that Marumoagae had taken out an insurance policy on Mokgethi without her consent, a sinister act underscoring his malicious intent.

Despite Marumoagae's lack of success in claiming the insurance money, the revelation of this policy significantly contributed to the case against him. With sufficient evidence in hand, Marumoagae faced the law, and on 20 June 2023, following a warrant for his arrest, he was taken into custody with no bail granted.

The matter escalated to the High Court, where Marumoagae was found guilty of murder. Beyond the life sentence, the court also ruled that Marumoagae would be permanently barred from firearm possession under section 103 of the Firearms Control Act, emphasizing the gravity of his crime.

The sentencing has been widely commended, with North West Provincial Commissioner, Lieutenant General Sello Kwena, and Director for Public Prosecution, Dr. Rachel Makhari, expressing their support for the outcome. They extended their gratitude to State Prosecutor, Advocate Dibuseng Ntsala, and Investigating Officer, Detective Sgt Buti Matlhoko for their unwavering commitment to the case. Their dedication not only ensured a successful conviction but also upheld the integrity of the justice system in South Africa.

The case has shed light on the importance of vigilance and thoroughness in investigating crimes of such a personal and brutal nature. It serves as a poignant reminder of the ongoing struggle against gender-based violence and the need for the legal system to dispense justice uncompromisingly.
