Inquiry Uncovers Grave Safety Concerns at Durban Courts

An extensive inquiry into the infrastructure of the Durban Magistrate’s Court, led by Acting Regional Court President KZN Meerchand (Anand) Maharaj, has laid bare shocking hazards that compromise the safety of the building’s users and hinder judicial processes.


The critical situation came to light following an incident where a murder-accused was unable to attend their hearing due to the persistent breakdown of the prisoners’ lift, which serves the courthouse, including the 10th floor where the case was scheduled. This malfunctioning lift has instigated a broader investigation into the systemic issues affecting the courthouse.


Captain Gonam Govender, a seasoned SAPS member with 30 years of service at the court, revealed during her testimony the frequent breakdowns of the sole operational lift, noting breakdowns as many as seven times daily. This not only delays court proceedings but also presents significant security concerns as prisoners are restricted from using public elevities or stairways.


The distressing state extends to non-functioning CCTV systems, absent emergency lighting, and consistent plumbing issues causing water damage and foul odours emanating from prisoner facilities. Kritish Prag, the court's manager, acknowledged these chronic problems, including rampant lift breakdowns, stolen piping, and neglected water damage.


Highlighting the severity of the issue, it was revealed that the building’s fire-line has been disconnected since January 2023. Despite urgent instructions from the fire department, corrective actions have been delayed, leaving the safety of building occupants at risk in a potential fire emergency.


The Department of Public Works’ regional manager, in an attempt to address these concerns, proposed an action plan, while spokesperson Lennox Mabaso assured that a turnaround strategy is in place, citing budget constraints from client departments as a challenge. Mabaso further promised the modernization of lifts and other long-term infrastructure projects to rectify these safety breaches.


In conclusion, Maharaj ruled the delays caused by infrastructure failings as unreasonable, stressing the critical safety violations that make the courthouse a potential fire trap. Mabaso expressed that the Department of Public Works is focused on enhancing access to justice with a habitable environment and has approved planning for necessary modernization projects.
