South African eMedia Channels Secure Extension on DStv Amidst Competition Tribunal Proceedings

In a move that will retain television diversity for South African viewers, the Competition Tribunal has recently granted an extension for eMedia Investments' channels to remain accessible on the DStv satellite platform. This development is the latest in an ongoing legal standoff between eMedia Investments and MultiChoice, the parent company of DStv.

Last Monday, in a pivotal decision, the Competition Tribunal granted an application by eMedia to extend the interim relief order previously granted against MultiChoice. As a result, eMedia's portfolio of channels, including e.tv Extra, eToonz, eMovies, and eMovies Extra, will remain available on DStv for the time being. This ruling comes after the Competition Appeal Court came down in favor of the interim relief in August of the previous year, following the tribunal’s initial decision against it in May.

The interim order, which was initially prolonged by mutual agreement between the two media giants until July 31 of this year, has now been further extended for six months from last Monday. This extension is either to last for the aforementioned period or conclude with the finalization of a hearing that delves into the complaint referral lodged by eMedia with the tribunal—whichever comes first.

Since the year 2017, MultiChoice has harbored an agreement with eMedia whereby it acquires, markets, and distributes the four channels in question. However, in a twist that sparked the current dispute, MultiChoice elected not to renew this agreement last year. eMedia, in response, filed a complaint citing MultiChoice’s refusal to carry the discontinued channels as an "abuse of dominance" — a breach of antitrust laws designed to prevent market monopoly and ensure fair competition.

MultiChoice stands firm on its stance, claiming that the decision not to renew the agreement was based purely on commercial reasoning. Nevertheless, the tribunal has decided to uphold the extension despite opposition from MultiChoice, engaging both parties in what is likely to be a protracted legal battle. The tribunal has stated that the subsequent rationale behind its latest decision will be disclosed at a later time.

The anticipation for the hearing, which is slated for August 2024, continues to build. This period will serve as a momentous time for both eMedia and MultiChoice, as they present their cases in a dispute that can potentially reshape South Africa’s broadcasting landscape. The hearing's outcome will dictate not only the future of eMedia’s channels on DStv but could also send ripples through the country’s broader media regulation framework.

In the meantime, South African viewers can rest assured that eMedia’s content, which includes a variety of entertainment and educational programming, will remain uninterrupted on DStv, contributing to the diversity of television offerings in the country. How this legal battle will conclude is up in the air, yet for now, the tribunal's order secures a temporary win for eMedia and the audiences that enjoy their channels.
