Court Exempts Man from Spousal Maintenance After Uncovering Wife's Concealed Income

In a significant court ruling, a Johannesburg husband has been absolved of paying R10,000 monthly spousal maintenance by the South Gauteng High Court. The decision followed the discovery of his estranged wife's concealed income, which she failed to fully disclose during divorce proceedings.


The couple, having two children together, opted for a marriage out of community of property with accrual. This marital regime requires that spouses share any asset value accrued during the union once the marriage is dissolved. The wife sought divorce in May 2021, leading to ongoing litigation to resolve the dissolution terms.


An interim order, issued under Rule 43—designed to provide temporary financial relief—compelled the husband to pay a substantial amount in child and spousal maintenance, totaling over R27,000. However, the husband presented a challenge to the spousal maintenance portion in August 2023, backed by revelations concerning his wife's income.


The case took a turn when the husband scrutinized the financial affidavits provided by his wife, discerning that her after-tax income was significantly higher than initially reported. The formal financial disclosures at the time of the Rule 43 application pegged her income at R10,000 post-tax, but subsequent bank statements reflected an average monthly income of over R34,000 from January to August 2023.


Moreover, the husband identified a R20,000 transaction from a business account in 2022 that was not declared in the initial affidavit. Furthermore, evidence was presented of the wife's robust business activity, including a course advertised on Facebook, which fetched R4,350 per attendee, and another business venture, OCL Rental, from which she derived additional income.


The court found merit in the husband's argument and concluded that the wife had not been forthright about her financial situation. Judge Portia Nkutha-Nkontwana deemed the wife's non-disclosure a serious issue and released the husband from his spousal maintenance duty, although he is still required to contribute to his children's upbringing.


This case has drawn attention to the significant implications of failing to disclose income and assets honestly in divorce proceedings, inevitably impacting the judgments pertaining to maintenance obligations. It serves as a caution for parties involved in similar disputes to maintain transparency to ensure fair outcomes.
