Western Cape Teacher Dismissed and Charged with Rape of Grade 9 Pupil

In a disconcerting incident at Masakheke High School in Nkqubela, Robertson, the Education Labour Relations Council (ELRC) has dismissed Sivatho Rigala, a high school teacher, due to severe allegations against him involving a minor. The teacher has been implicated in a case where a Grade 9 pupil under his charge fell pregnant, with subsequent actions by the teacher raising grave legal and ethical concerns.

The case unfolded after the victim, referred to as Learner A, accused Rigala of predatory behavior that began on a Facebook group meant for educational purposes. As detailed in her harrowing account, Rigala's misconduct escalated from inappropriate messaging to demanding explicit images, culminating in an alleged sexual assault at his residence in January 2022.

Evidence provided by Learner A reveals the abuse of power and manipulation by Rigala, who even coerced her into deceitfully accusing an innocent peer from her church choir of being responsible for the pregnancy. His nefarious plan included promises of compensation to the boy for accepting the blame. This calculated attempt at deception amplifies the severity of Rigala's actions, reflecting a disturbing willingness to further exploit others to cover his misdeeds.

When the pregnancy was discovered and then lost due to a miscarriage seven months later, Rigala's strategy was unravelled, leading her father to the police, which resulted in the teacher's arrest on charges of assault and rape. The arrest brought forth Rigala's defense, which hinged on denial and claims of an elaborate plot against him.

Despite his defense, Arbitrator Arthi Singh-Bhoopchand saw through the conspiracy theories Rigala spun, deeming his evidence insufficient and his actions following the pupil's miscarriage as inexcusable negligence, especially for an educator responsible for the welfare of children. The ELRC noted this inaction as further proof of the credibility of Learner A's claims over Rigala's narrative.

The termination of Rigala's employment is an immediate consequence of this judgement. As the criminal proceedings progress, the community of Nkqubela and the broader educational fraternity will closely monitor the developments, with many seeking justice for the gross violation committed by someone tasked with protecting and educating young minds.
