ANC Seeks ConCourt Intervention in Legal Tussle Over Cadre Deployment Records with DA

In an unfolding political saga, the African National Congress (ANC) is taking its legal battle to secure its cadre deployment records to South Africa's apex court—the Constitutional Court, in an attempt to shield them from the Democratic Alliance (DA).



This move comes hot on the heels of the ANC's unsuccessful attempts at both the High Court and the Supreme Court of Appeal (SCA) to block a ruling requiring it to release these documents.


Over the past three years, the DA has persistently challenged the ANC’s cadre deployment policy in two distinct cases. The crux of the DA's argument is that these cadre appointments catalyzed state capture and widespread corruption.


Despite the ANC’s legal bids falling flat in both lower courts, the party displays an indomitable spirit as it gears up for a Constitutional Court hearing.



In correspondence shared between the party’s attorneys, the ANC alerted the DA of its intent to escalate the matter to the ConCourt.


DA MP, Leon Schreiber, dubbed the ANC's decision as seeming desperate and rather thoughtless, adding that, "Cadre deployment impacts the public through load shedding and widespread service delivery collapse. Thus, the public inherently possesses a constitutional right to access the cadre deployment records."


The DA remains steadfast in its resolve to challenge cadre deployment, notwithstanding any delays the ANC's fresh legal maneuver might cause in sharing its decision-making process.


However, the High Court in Pretoria’s verdict on the DA's second case—seeking the declaration of cadre deployment as both unlawful and unconstitutional—still hangs in the balance.
