In a bold move reflecting the South African government's commitment to combating corruption, President Cyril Ramaphosa has unleashed the Special Investigating Unit (SIU) on the Nelson Mandela Bay Metropolitan Municipality (NMBMM). This follows allegations of serious maladministration and financial irregularities within the municipality's operations. Proclamation 170 of 2024 represents a concerted effort to cleanse Nelson Mandela Bay of corrupt practices and to recoup any financial losses suffered by the State or the metropolitan municipality.
The SIU's scope of investigation, as dictated by Proclamation 170, is extensive. The focus is on scrutinizing the procurement and contracting processes related to the supply, delivery, and off-loading of LED street and flood lighting luminaires. Concerns have been raised about these processes being neither fair, competitive, transparent, equitable, nor cost-effective. Given the vital role that street lighting plays in urban safety and efficiency, any compromise on procurement integrity is of significant public concern.
The Unit is also tasked with delving into unauthorized, irregular, fruitless, and wasteful expenditure by the NMBMM or the State. The investigation will further explore any unlawful or improper conduct by officials, employees, suppliers, service providers, or any related parties. The deep dive covers a time frame extending from 1 November 2020 to the publication date of the Proclamation on 12 July 2024. However, relevant misconduct occurring outside this period but connected to the core issues is also within its investigative radar.
The SIU's mandate is not only to unmask malfeasance but also to make systemic recommendations to bolster measures against future losses. It operates under the Special Investigating Units and Special Tribunals Act 74 of 1996, which empowers it to refer any evidence suggestive of criminal conduct to the National Prosecuting Authority (NPA) for potential prosecution. Moreover, the Unit has the authority to pursue civil litigation to correct any maladministration, corruption, or fraud it uncovers.
The actions of the SIU are critical in restoring public confidence in the governance of Nelson Mandela Bay, ensuring that taxpayers' money is safeguarded against misuse.
