EU Commission vs. 𝕏: Allegations of Requesting Censorship and a Legal Battle Brewing

Recently, reports have emerged indicating that the European Commission may have proposed a clandestine arrangement to a major social media platform, referred to as 𝕏 in this article, asking it to implement strict content moderation practices. The platform's CEO, Elon Musk, hinted in a tweet about a supposed illicit proposal from the EC, which he claimed other platforms had accepted but 𝕏 had refused. According to Musk, this secret offer included the quiet censorship of certain speech, without transparent communication to the public.

This assertion of covert negotiations surfaces amidst a broader dispute between 𝕏 and the EU regarding the new Digital Services Act (DSA), which was fully implemented this February. The EC accused 𝕏 of transgressing the act’s standards concerning its verification system and transparency requisites related to advertising and data access for researchers. The DSA has been designed to enforce a safer and more equitable online environment within Europe, mandating platforms to enact a transparent and accountable system for content management.

The bone of contention lies in the introduction of payment for blue check verification on 𝕏, which the EC contends deviates from the DSA. EC Commissioner Thierry Breton emphasized the blue checkmark's previous association with reliable sources, which has ostensibly been diluted by the new subscription-based verification model. Consequently, the EC warned that non-compliance could result in substantial penalties amounting to 6% of the platform's international yearly turnover.

Additionally, Musk’s public flashpoint with Brazilian lawmakers echoes a similar theme of conflict over content regulation. The situation led to attempts to force 𝕏 to cull particular accounts critical of the official stance, culminating in the platform's decision to acquiesce to Brazil’s constraining directives.

In retaliation against the EC's draft findings, Musk has stated an intent to legally challenge any enforceable actions.
