In an assertive move by South African authorities against financial malfeasance, a high-profile arrest has been made in Eastern Cape. Mpumelelo Equest Mdanda, a 46-year-old company director, and his two corporations, M.T and A.O Trading Pty Ltd, are at the fulcrum of a major Value Added Tax (VAT) fraud investigation. On July 8, 2024, Mdanda was apprehended by the Gqeberha-based Serious Commercial Crime Investigation (SCCI) division of the Hawks, working in concert with the National Prosecuting Authority's (NPA) Serious Tax Unit (STU).
The case pivots around allegations concerning Mdanda's deliberate submission of falsified VAT returns and unauthorised changes to contact and banking information, which precipitated illegitimate VAT refunds, according to the prosecuting authorities. The discrepancies surfaced during a routine audit by the South African Revenue Services (SARS), triggering an alert and consequently a formal complaint to the Hawks.
Subsequent scrutiny of the case, spearheaded by the tenacious task force from the SCCI and STU, brought to light that SARS had been deceived out of a staggering sum exceeding R2.7 million in actual financial loss and was nearly compromised for an additional R4.6 million - cumulatively nearing R7.3 million in potential losses.
The arrest is a testament to South Africa's zero-tolerance stance against fraudulent activities, particularly those pertaining to tax-related crimes, often regarded as a scourge that undermines the country's fiscal health and governance.
Mdanda's initial court proceeding was held at the Gqeberha New Law Magistrate’s Court on the same day as his arrest. Interestingly, the court granted him release on a warning, with a follow-up hearing scheduled for August 1, 2024, where Mdanda will present his legal representation.
