Allegations of Unlawful Targeting: Thabo Bester’s Legal Team Claims Neglect of Medical Dietary Needs

Following a recent court session in Johannesburg, the legal representation of Thabo Bester has launched allegations of mistreatment against prison authorities. They contend that Bester, who was apprehended after a bold escape from the Mangaung Correctional Centre, is not receiving the medically necessary meals that correspond with his diabetic condition, placing him in potential jeopardy.


Bester, who is contending with a life sentence for serious charges including rape and murder, faced the Bloemfontein High Court, recounted by his cohort Dr Nandipha Magudumana, her father Zolile Sekeleni, and five others implicated in the escape that took place in May 2022. The accusations of neglect emerged during a court proceeding in which Bester asserted his right to proper treatment while in state custody.


Lead defense attorney Mohamed Seedat brought the concern to the forefront, explicating the significance of a specially tailored diet for his client’s diabetes management. State prosecutor Advocate Amanda Bester had previously noted that Thabo Bester had been steadfast in his refusal of the meals offered in prison, despite the necessity of ingesting chronic medication to address his medical condition.


The fallacy of Bester's refusal became apparent as Seedat clarified the high sugar and carbohydrate content in the prison's meals, which could adversely affect Bester’s blood sugar levels. The decision to deny Bester the specific meals required for his condition struck a contentious note in the courtroom, interpreting it as a targeted move by the correctional facility's staff.


In stark contrast to prior court appearances where Bester showcased extravagant designer attire, he presented in subdued attire, clad in a plain white t-shirt, a change explained by his legal team as enforced by the prison officials’ directives — further adding to the perception of Bester being specially targeted by corrections protocols.


While these assertions remained unaddressed by Advocate Bester in the proceedings, the protocol adherence emphasized by the court and correctional services leave this concern in a state of limbo. It raises questions about the extent of the rights and wellbeing of individuals serving sentences, and whether the system is fulfulling its duty of care, particularly from a medical standpoint.
