A legal conflict has arisen between former Eskom executive Solly Tshitangano and Andre de Ruyter, the author of the book "Truth to Power: My Three Years Inside Eskom" and former CEO of the state-owned power utility. Tshitangano, who served as Eskom's chief procurement officer, is taking a stance against what he alleges are defamatory references and accusations detailed in de Ruyter’s recently published work.

Tshitangano's decision to fight back has culminated in the service of legal papers not only to de Ruyter himself but also to his publishing company, Penguin Random House. News24 reports that Tshitangano's legal demands include both a public retraction of the allegations made in the book and an apology. The claims under scrutiny are numerous, some accusing Tshitangano of professional ineptitude and others of leaking sensitive information to political parties and colluding with a controversial faction within the ANC.

In "Truth to Power," de Ruyter describes a fraught relationship with Tshitangano, suggesting a breach of trust and accusing him of mismanaging his responsibilities, notably with regards to the company Econ Oil. This firm was contracted to supply fuel to Eskom but has since faced a ten-year ban following allegations of corruption and unethical behavior.

According to de Ruyter, the working behaviour of Tshitangano reached such a level of concern that a disciplinary hearing was convened in 2021, leading to his dismissal for gross misconduct and dereliction of duties. De Ruyter's narrative is further supported by the outcomes of multiple inquiries, including one led by Advocate Ishmael Semenya, which dismissed Tshitangano’s counter-accusations against de Ruyter.

However, Tshitangano refutes these charges, claiming instead that de Ruyter's narrative is not only unfounded but also injurious to his reputation. Through his counsel, Tshitangano insists on his longstanding professional credibility, asserting that de Ruyter's allegations have not only tainted his reputation but also impacted his dignity and professional integrity.

This legal matter underlines the deep complexities and the contentious interplay of personalities, power, and allegations of corruption within Eskom, a company at the forefront of South Africa's ongoing struggle to stabilize its energy supply. As Tshitangano seeks to clear his name, de Ruyter and Penguin Random House have expressed their intention to stand by the book's contents and to defend it in court if necessary.

As this story develops, the implications of how such a public dispute may affect perceptions of integrity within public enterprises and the publishing industry will keenly be observed. Whatever the eventual outcome, the legal friction between Tshitangano and de Ruyter promises to be a significant account of accusation and defense within South Africa's corporate narrative.
